Error to a judgment of the Hustings Court of the city of Petersburg, in an action of assumpsit. Judgment for plaintiff. Defendants assign error.

This case is here for the third time, and before this action was instituted in the State court there had been a similar action in the United States courts in which -the *251plaintiff suffered a non-suit. Atlantic Coast Realty Co. v. Robertson, 240 Fed. 372, 153 C. C. A. 298; Atlantic Coast Realty Co. v. Townsend, Ex’r, etc., 124 Va. 490, 98 S. E. 684; Robertson’s Ex’r v. Atlantic Coast Realty Co., 129 Va. 494, 106 S. E. 521.

Its object is to recover compensation which the plaintiff claims because of the breach of an alleged parol contract giving it the exclusive agency to sell certain real estate.…
