This is an appeal from the small claims-magistrates court, Palm Beach County. The question presented relates to whether the appellee, Michael T. Wilson, having been arrested and taken into *142custody for operating a motor vehicle while under the influence of alcohol, had a right to the presence of his attorney before giving a sample of his breath for chemical analysis.
