ALARID, Judge.

Plaintiff, Environmental Improvement Division of the State of New Mexico Health and Environment Department (plaintiff), appeals the trial court’s order granting defendant, Bloomfield Irrigation District (defendant), summary judgment on both causes of action pled in plaintiff’s complaint.
