Plaintiffs Frank, Ellen, Deanna and Theresa Mancuso (“the Maneusos”) brought this action against Defendants Consolidated Edison Co. of New York (“ConEd”), as a citizen suit under the Clean Water Act, see 33 U.S.C. § 1365, with pendent claims under New York state law for personal injuries and property damage allegedly caused by PCB contamination of their property.
