OPINION

SMITH, Chief Judge.

This case comes before the court on defendant’s motion to dismiss. Plaintiffs seek damages for the termination of health care services provided by the Indian Health Service (IHS), an agency within the Department of Health and Human Services. Plaintiffs allege that their health care services were terminated without due process of law since they were not given an opportunity to appeal the termination decision.
