Appeal from an order and judgment of the Supreme Court (Aulisi, J.), entered June 13, 2006 in Warren *1288County, which, in a combined proceeding pursuant to CPLR article 78 and action for declaratory judgment, among other things, granted petitioners’ motion for summary judgment annulling Local Law No. 2 (2002) of the Town of Horicon.
