This case requires us to determine whether the New York City Council complied with the State Environmental Quality Review Act when it enacted Local Law No. 38 (1999) of, the City of New York, the City’s latest effort to address the abatement of lead paint in multiple dwelling units. Contemporaneously with its passage of Local Law 38, the City Council adopted a resolution declaring that the new law would have no significant adverse impact on the environment. We hold the City Council’s negative declaration does not set forth an adequate explanation clearly…
