The accusation against Hatheock contained two counts. The first was that Hatheock was guilty of th'e offence of misdemeanor, “in that said Hatheock, in Fulton county, on or about May 28, 1889, did, b.y false and fraudulent representations as to his own responsibility, wealth and commercial standing, cheat and defraud A. P. Morgan out of certain merchandise to the value of $921.35, to wit: The said W. M.
