The plaintiff in error was jointly indicted with two others (who are not parties to this appeal) upon four counts. The first count charged unlawful possession of intoxicating liquor; the second, unlawful possession of property designed and intended for use in the manufacture of intoxicating liquor; the third, unlawful manufacture of intoxicating liquor'; a.nd the fourth, the maintenance of a common nuisance, as defined by section 21 of title 2 of the National Prohibition Act (Comp.
