The defendant, Edgar Tatum, was charged in an information with one count of murder in violation of General Statutes § BSa-SAa1 and one count of assault in the second degree in violation of General Statutes § 53a-60 (a) (2).2 At trial, the jury returned a guilty verdict on the murder charge, but failed to return a verdict on the assault charge.3 The defendant was subsequently sentenced to a term of sixty years for the *723murder conviction.
