Tarsney, J.:

This is an action for forcible entry and detainer commenced by defendant in error, Theodore H. Weise, against the plaintiffs in error, before a justice of the peace in Pottawatomie county, and appealed to the district court' of said county, where judgment was rendered in favor of the defendant in error, and the cause was brought to this court for review.'
