This was an action brought in the probate court of Oklahoma county by P. J. and J. T. Hill, partners as Hill Brothers, against the city of Oklahoma City, to recover possession of lots 40 and 41, in block 23, in Oklahoma City.

The plaintiffs alleged in their bill of particulars that on the 31st day of October, 1893, they were in peaceable and rightful possession of the property described, and that the defendant and its officers wrongfully, illegally and forcibly entered upon the premises and forcibly took possession thereof, and that the…
