ORDER

FORRESTER, District Judge,

This matter is before the court on the Magistrate Judge’s Report and Recommen dation that the Secretary of Health and Human Services’ determination that the claimant was not entitled to be paid, by Medicare because her medical costs had been covered by her primary insurer under 42 U.S.C. § 1395 be affirmed. The claimant has timely filed objections to the Report and Recommendation. This court declines to adopt .the Report and Recommendation for the following reasons.
