ESCHBACH, Senior Circuit Judge:

The United States appeals from the sentence of an alien who was convicted of illegally reentering the United States after having been deported. See 8 U.S.C. § 1326 (West 1992). The United States argues that the defendant’s sentence should have been enhanced under U.S.S.G. § 2L1.2(b)(1) because he was convicted of the felony of passport fraud prior to his deportation. The section provides: “If the defendant previously was deported after a conviction for a felony, other than a felony involving violation of the immigration laws, increase by 4 levels.” The district…
