Appeal by the defendant, Henry Fritz, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 23d day- of June, 1899, upon the verdict off a jury, and also from an order entered in said -clerk’s office on the 29th day of July, 1899, denying the defendant’s motion for a new trial made upon the minutes.

The plaintiff, alleging that the defendant Fritz was, in the year .1891, a director of the California Vintage Company, a -corporation •of the State of New York, brought this action to enforce the liability created by section 30 of the Stock Corporation Law (Laws of *2351890, chap. 564, as aind. by Laws of 1892, chap. 688) for the failure to file an annual report of that corporation during the month of January, 1897, as required by that section.
