[1] This is a suit to enjoin the county of Los Angeles from taking possession and throwing open to public use a highway condemned in a suit in the .superior court of California by the county of Los Angeles against tbe predecessors of the plaintiff in this case. The judgment of -condemnation has been affirmed by the Supreme Court of the state, and is a final judgment.
