The defendants in error, Jenness, Gage, & Co-., instituted this .suit against Philip Peck and William Bellows, in the Court of Commtm Pleas of Cheshire county, New Hampshire, demanding the sum of $ 2,000, for goods sold and delivered. The action was served according .to the practice of that State, on the 10th of October, 1842, by the'attachment of the goods, chattels, and lands of the defendants.
