Plaintiff brought suit in circuit court to recover damages for a personal injury claimed to have been sustained by him while in the employ of the defendant railroad company. The first count of the declaration was based on the provisions of the Federal employers’ liability act, 45 USCA, § 51 et seq., plaintiff alleging that at the time of his injury, on or about December 17, 1946, he was employed in interstate commerce.
