Petitioner brought this action in an Illinois state court, under the Federal Employers’ Liability Act 1 and the Boiler Inspection Act, 2 for personal injuries sustained on February 6, 1937, in the course of his employment as a brakeman in interstate commerce. A general verdict of $32,500 was returned in his favor by the jury, but on appeal the Appellate Court of Illinois for the First District entered judgment for respondent notwithstanding the verdict. 3 The Supreme Court of Illinois refused leave to appeal.
