Jeoffrey L. Burtch (“Burtch” or “Appellant”), Chapter 7 Trustee of Factory 2-U Stores, Inc. (“Factory 2-U”), appeals the District Court’s May 31, 2009 Order granting Defendants’ Motion to Dismiss as well as the District Court’s June 4, 2010 Order denying leave to amend Burtch’s Complaint.
