The underlying action in this case was brought by the plaintiff insurance carrier against the defendant insurance agency. The action alleged both breach of contract and negligence on the part of the defendant. The jury returned a verdict in favor of the plaintiff on the breach of contract claim and in favor of the defendant on the negligence claim. The plaintiff filed motions to set aside the verdict and for additur, which the trial court denied.
