This action was brought to recover the value of a number of bales of cotton netting which, it is claimed, was defective, and damages for the loss sustained by reason of failing to catch the quantity of fish which would have been caught had the netting, which was worked into the purse seine, not been defective. The cause was tried to the court and a jury, and resulted in a verdict in favor of the plaintiff for $2,500 for loss of fish and $445.96 for the loss of the net.
