GANTMAN, J.:

¶ 1 Appellant, the Commonwealth of Pennsylvania, appeals from the order entered in the Philadelphia County Court of Common Pleas, dismissing the charges of possession with intent to deliver a controlled substance (“PWID”),1 knowing and intentional possession of a controlled substance,2 possession of drug paraphernalia,3 and criminal use of communication facilities4 against Appellee, Samuel King, and discharging him.
