The Official Committee of Unsecured Creditors of 360networks (USA) inc., et al. (the “Plaintiff’) brought an action against Pirelli Communications Cables and Systems USA LLC (“Pirelli” or the “Defendant”) seeking the avoidance, recovery, and turnover of certain preferential transfers pursuant to §§ 547 and 550 of the Bankruptcy Code.
