MEMORANDUM OPINION
COOPER, District Judge.
I. INTRODUCTION
The plaintiff, Kevin M. McCann, M.D., brings this action against, among others, the defendant Provident Life and Accident Insurance Company, sued here as “Unum Provident” (“Provident”). (See generally dkt. entry no. 1, Compl., Count I.) McCann alleges that he purchased a supplemental long-term disability (“LTD”) insurance policy (“the Policy”) from Provident in 1991.
