Before the Court is Defendant’s Motion for Partial Summary Judgment (Doc. 140). For the reasons stated hereafter, Defendant’s Motion will be DENIED.

I. BACKGROUND

As a preliminary matter, the Court notes that Defendant is only seeking summary judgment as to the Government’s use of statistical sampling for Counts I and II of its Consolidated' Complaint in Intervention.
