BOYD, District Judge.

The plaintiff, Continental Grain Company, hereinafter referred to as Continental, a Delaware Corporation, on March 16, 1956, filed this suit against the First National Bank of Memphis, hereinafter referred to as The Bank, a Corporation organized under the National Banking Act, 12 U.S.C.A. § 1 et seq., and Charles G. Black, Trustee in Bankruptcy for the Butler-Foster Milling Company. Plaintiff asks the Court to declare a recision of a soybean trade between the plaintiff and the Butler-Foster Milling Company, hereinafter referred to as Milling Company. This trade was made…
