MEMORANDUM OPINION

In this lawsuit, Edar Y. Rogler, Esq., has sued the U.S. Department of Health and Human Services and Secretary Kathleen Sebelius 1 under the Privacy Act, 5 U.S.C. § 552a; the Administrative Procedure Act, 5 U.S.C. § 551 et seq.; and the Declaratory Judgment Act, 28 U.S.C. § 2201 et seq. 2 Despite repeated extensions of time, she has failed to respond to Defendants’ Motion to Dismiss the First Amended Complaint and now asks the Court to stay this case pending the appeal of a prior case, Rogler v.
