GRISSOM, Justice.

Mrs. Ruby Shaw, individually, and as next friend of her minor children, filed this suit against the City of Munday, a municipal corporation, for damages caused by the death of her husband, William Shaw, while an employee of the city.

Plaintiffs alleged that Shaw at the time of his death on the 23d day of April, 1935, and-prior thereto, was employed by the defendant to assist in operating the city’s sewer and wate'r systems; that he also assisted in the maintenance of the streets, alleys, and sewer disposal plant, and the ground surrounding the same; that on the date of his…
