This action was instituted by John A. Jack, doing business as J. A. Jack and Sons, upon a “contractor’s equipment policy,” whereby the defendant, Standard Marine Insurance Company, Limited, of Liverpool, England, insured plaintiff in the amount of seven thousand five hundred dollars against damage to a “D2 Bucyrus Diesel Shovel.” By the second amended complaint, it was alleged that, during the term of the policy, the diesel shovel, while being operated in connection with construction work in progress on land within the Duwamish waterway, which had been leased by the plaintiff, suffered damage…
