Petitioner Benny Williams appeals from an order of the United States District Court for the Southern District of New York, Whitman Knapp, Judge, dismissing sua sponte petitioner’s application for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Williams was convicted of burglary in the second degree and attempted robbery in the second degree, following a jury trial in New York State Supreme Court, and he was sentenced to concurrent prison terms of four to eight years and two and one-half to five years.
