WITMER, District Judge.

A search warrant was issued at the instance of a national prohibition agent, and certain property of the defendant was seized, followed by the filing of a libel under which the seized property was taken into custody, to the end that the same be confiscated for violation of the National Prohibition Act (Comp. St. Ann. Supp. 1923, § 10138% et seq.). Motions were filed to quash the search warrant, to set aside service thereof, and to dismiss the libel.
