Appeal from an order of the Supreme Court (Hughes, J.), entered January 12, 1998 in Albany County, which granted defendant’s motion for summary judgment dismissing plaintiffs fourth cause of action.

The instant appeal arises out of a power sales contract entered into between plaintiff and defendant in February 1988, pursuant to the terms of which defendant agreed to purchase power generated by a plant to be constructed by plaintiff in the Town of Halfmoon, Saratoga County.* The contract called for the facility to be operational by December 31, 1993 and, insofar as is relevant to this appeal,…
