Plaintiff recovered for personal injuries he received at Kalamazoo, while crossing the railroad tracks of defendant company, by being run over by the engine of a freight train, which injuries he claims were caused by the negligence of defendant’s agents and servants. The injuries were severe and the judgment substantial. The case is here for review upon errors assigned; the chief contention of defendant being that plaintiff was guilty of contributory negligence, and that the court should have instructed a verdict for defendant on that ground.
