MACY, Chief Justice.

Appellant Roy F. Brenning III pleaded guilty to six counts of grand larceny by bail-ee and was sentenced to incarceration, ordered. to pay restitution, and assessed a surcharge to' be paid to the crime victims’ compensation account. He appeals from the terms of his sentence.

We affirm.

Appellant poses two issues for our review: Issue I

Whether W.S. § 7-13-421(c) violates the constitutional requirement of separation of powers[.]
