MEMORANDUM OPINION AND ORDER

Plaintiff, Michael G. Marinangeli (“Marinangeli”), commenced this action pro se against defendant, Bruce A. Lehman, Commissioner of Patents and Trademarks (“Commissioner”). 1 Marinangeli, an attorney, alleges his suspension from practice before the Patent and Trademark Office (“PTO”) violates the Administrative Procedure Act (“APA”), and various provisions of the United States Constitution.
