MEMORANDUM OPINION AND ORDER

NEESE, District Judge.

This is an action in which the plaintiff Mr. Phipps seeks money damages and injunctive relief for the violation of his federally protected civil rights. 42 U.S.C. §§ 1983, 1985. The defendants, Honorable John Byers, and Carl Kirkpatrick, Esq., are sued individually as well as “agents” of the state of Tennessee. The state of Tennessee cannot be brought herein as party defendant in this manner. It is not a “person” within the meaning of 42 U.S.C. § 1983. Wampler v.
