A magistrate of this district recommended that a judge of this Court treat the motion of the defendants to dismiss this action for the failure of the plaintiffs to state a claim on which relief can be granted, Rule 12(b)(6), Federal Rules of Civil Procedure, as a motion for a summary judgment, Rules 12(b), 56(b), Federal Rules of Civil Procedure, and deny the same, except as to the plaintiffs’ pendent state claim for the tort of outrageous conduct. 28 U.S.C. § 636(b)(1)(B).
