District of Columbia Court of Appeals

1Opinion of the Court

KING, Associate Judge:

In this appeal we are asked to determine whether it was error, in the principal claim, for the trial judge to award a procuring cause broker a commission arising from an implied-in-fact contract in a real estate transaction, and whether the motions judge erred in granting summary judgment in favor of third-party defendants. We affirm the judgment entered by the trial judge on the principal claim, but we reverse the grant of summary judgment.
