This is a quo warranto brought by appellant, Edward A. Schofield, in the Court of Common Pleas of Allegheny County to determine title to the office of City Clerk of Pittsburgh.

The relator filed the suggestion that he was elected city clerk by the city council on September 2, 1936, to fill the unexpired part of the three-year term of Robert Clark, who had been elected on April 6, 1936, and had resigned. Relator qualified and entered upon his duties as city clerk and continued in office until January 17, 1938, when he was removed by a resolution of the city council…
