OPINION

COWEN, Circuit Judge.

Former Commissioner of the Delaware River Port Authority of Pennsylvania and New Jersey (“DRPA”), Max Pievsky, filed a complaint challenging the Governor of Pennsylvania’s power to remove him without cause under the terms of the DRPA Compact, an interstate agreement between the Commonwealth of Pennsylvania and the State of New Jersey. The district court dismissed the complaint on summary judgment, concluding that the Governor of Pennsylvania had the power to remove DRPA Commissioners prior to the expiration of their terms.
