The question presented in these quo warranto proceedings is the constitutionality of the Act of May 28, 1937, P. L. 939, and applying to counties of the third class, to wit: Luzerne, Lackawanna, Westmoreland, Delaware and Montgomery. In section 1 it purports to create “a board to be known as the Board for the Assessment and Revision of Taxes which shall be composed of three members resident of the county for which appointed.
