Kilday, Judge:

Accused was tried by a special court-martial at McChord Air Force Base, Washington. Despite his plea of not guilty he was convicted of assault on Staff Sergeant Verratti by striking him in the face with a piece of broken glass, a means likely to produce grievous bodily harm, in violation of Article 128, Uniform Code of Military Justice, 10 USC. § 928. He was sentenced to be discharged from the service with a bad-conduct discharge. The sentence was approved by the convening authority and the officer exercising general court-martial jurisdiction.
