Kilday, Judge:

As a consequence of his acts on the evening of the incident with which we are here concerned, the appellant was brought to trial before a general court-martial-, convened in Germany. He pleaded not guilty, but was convicted of assault whereby serious bodily injury was intentionally inflicted, in violation of Article 128, Uniform Code of Military Justice, 10 USC § 928. He was sentenced to dishonorable discharge, forfeiture of all pay and allowances, confinement at hard labor for three years, and reduction to the lowest enlisted grade. The convening authority…
