SMITH, Justice.

Respondent is herein sometimes designated as Beutler, and appellant MacGregor Triangle Company as MacGregor. The Industrial Accident Board is herein sometimes referred to as the Board.

This is an appeal from a decision of the Industrial .Accident Board in favor of Beutler, to the effect that on August 30, 1960, he received a personal injury caused by an accident arising out of and in the course of his employment by defendant MacGregor, and is entitled to an award against MacGregor and its compensation surety, Workmen’s Compensation Exchange, under the Workmen’s Compensation Law,…
