Appellant filed a claim with the Industrial Accident Board, and thereafter filed his application for hearing. In his claim, he alleges inter alia that he sustained a personal injury by accident by contracting silicosis while he was working for respondent at the Hayfork Mine operated by respondent and located near Idaho City, Boise County, Idaho; that by reason of so contracting silicosis he became totally and permanently disabled from performing work and labor; that such personal injury was caused by respondent’s negligent operation of the mine.
