An appeal by the Yellow and Checker Cab Co. in a certiorari and mandamus proceeding from the denial of its motion to vacate the judgment or judgments entered in certain cases consolidated for trial. The motion was based upon the ground that the above named company, although it was not a party of record in the proceedings before the trial court, was the real party in interest; that the findings of fact are not supported by the evidence and that the conclusions of law are erroneous.
