The Court has before it the Motion for Summary Judgment of Defendant Illinois Central Railroad Company (“ICR”). Having considered the supporting and opposing memoranda and the attached exhibits, the Court rules that Defendant’s Motion for Summary Judgment is well taken and should be granted, and Plaintiffs cause of action should be dismissed with prejudice.
