Harry B. Head and Tillie O. Head . brought this action against the New York Life Insurance Company to recover upon a policy of life insurance. i

The petition alleged in part the following : That on August 27, 1926, the insurance company issued to Arthur O. Head a certain life insurance policy by which it’ agreed to pay $5,000 to the beneficiaries named in such poliey, upon receipt of due proof of the death of the insured, and the further sum of $5,000 if such death resulted from accident, as defined in the double indemnity clause of the policy; that…
