MEMORANDUM OPINION
WEINER, District Judge.
This diversity action for personal injuries was tried to the court sitting with a jury. The jury returned a verdict in favor of the defendant. 1 Presently before the court is the motion of the plaintiff for a new trial. For the reasons which follow, the motion is denied.
The plaintiff sets forth eight grounds for new trial. The first is that the court refused plaintiff’s request to send documentary evidence out to the jury.
